Among the producers of goods and entrepreneurs, there is a need for the temporary transfer of commercial samples, promotional materials, goods and equipment for demonstration at exhibitions and conferences, professional equipment in order to promote goods to foreign markets.
ATA Carnet (ATA Carnet) is an international customs document on the temporary importation of goods. It is equal to the customs declaration, as it is used to carry out customs operations and is positioned as an international guarantee covering the amount of taxes, fees, import duties.
The action of ATA Carnet applies to:
* commercial samples
* exhibits
* theater props
* sport equipment
* professional equipment and products that are not intended for repair, sale, modification, and commercial use.
The decorated ATA Carnet is accepted by the customs authorities of the countries of the Convention on Temporary Admission, which was adopted on June 26, 1990 in Istanbul.
The use of ATA Carnet allows you to identify products listed in the general list. There is no need to provide security for the payment of fees (duties, fees and taxes) to the customs authority in the case of temporary import / export of goods using the ATA Card.
Must be specified in the document of the name of the international guaranteeing system and the guaranteeing association. In the Russian Federation, the guaranteeing and outstanding association is the Russian Chamber of Commerce and Industry.
The maximum period of use of ATA Carnet in the Russian Federation does not exceed 1 year, starting from the day it is issued.
What goods are issued using ATA Carnet? Certain categories of goods may be declared and issued under the simplified procedure in accordance with the 1961 ATA Convention and the Temporary Importation Convention of June 26, 1990, as well as on the procedure for calculating and collecting customs payments in respect of temporarily imported goods using ATA Carnet (Annex Convention of June 26, 1990).
They also receive exemption from customs taxes, duties and fees for customs operations, including re-export from the Russian Federation, i.e. re-export
These products include:
* goods for demonstration or use at exhibitions, fairs, conferences and other similar events;
* professional equipment;
* containers, pallets, packaging, samples and other goods imported in connection with a commercial operation;
* goods imported for educational, scientific or cultural purposes.
The following products are not eligible for import / export to the territory of the Russian Federation using the ATA Carnet:
* prohibited for importation (exportation) or for which it is impossible to apply the customs procedure for temporary importation or temporary exportation;
* imported into the territory of the Russian Federation in order to carry out processing operations with them.
The use of ATA Carnet has several advantages:
* First of all, it is the temporary importation of goods exempted from customs duties, duties and taxes for a period of up to one year.
* The customs authorities of the countries participating in the international system Carnet ATA are accepted instead of national customs documents.
* Making an ATA Carnet is receiving an international guarantee of paying import duties and duties in case of violation of the temporary import regime.
* In the case of ATA Carnet, there is no need to provide bank guarantees, cash deposits, or deposits as security for customs payments.
* The carnet holder (i.e., the recipient of the ATA Carnet) only pays the insurance premium, which is 0.3% of the cost of the temporarily exported equipment (goods), and the services of the issuing organization (in Russia, the Chamber of Commerce and Industry of the Russian Federation).
* There is no need to fill in customs documents at each checkpoint across the customs border. ATA Carnet contains pre-filled separation sheets for customs authorities.
* Products issued in one ATA Card can be moved and accepted for transit (temporary admission) to several countries participating in the international ATA system.
Taking ATA Carnet, the customs authorities check its compliance with the established rules. Particular attention is drawn to the possibility of using the ATA Carnet with respect to imported goods, the validity period, the proper filling out of a general list of goods, the design of roots and tear-off sheets. The customs authority accepts ATA Carnet if all requirements are met.
It is not allowed to make any changes or additions to the document after the ATA Carnet has been accepted by the customs authority. This will require the written consent of the customs authority in the form of a resolution on the appeal of the holder. The ATA Carnet, presented to the customs authority, must be completed in one of three languages: Russian, English or French. All sheets should be filled in the same way, since they must contain the same information as the cover, which, together with the additional sheets, is then signed by the holder of the ATA Carnet indicated in column “A”. All other sheets are filled in during the passage of the customs of the countries participating in the international ATA system.
In case of loss, theft, destruction of goods or the ATA Carnet itself, the holder has the right to notify the customs authority, which has a voucher on its control, about this.
International relations are established and developed not only in the commercial sphere, but also in the sports, cultural, scientific, technical and other fields. The expanded list is contained in 12 annexes to the Convention.
Each contracting party must necessarily adhere to Annex A “On Temporary Admission Documents” (ATA and CPD Carnets) and at least one more Annex in accordance with the procedure upon ratification of the Istanbul Convention. Automatically after joining the Istanbul Convention, the country does not become a member of the international ATA system.
To acquire status, you must:
* In coordination with the customs authorities of a country wishing to become a member of the international ATA system, recognize at the state level an association that acts as a guarantor of payment to the customs authorities of the country in which it is established, fees, taxes, import duties in case of violation of the temporary import regime.
* Recognize an association authorized to issue ATA Carnets in the country.
* Acquire membership of the international network of guaranteeing associations through a certain guarantor organization, which is managed by the World ATA Carnet Council of the World Federation of Chambers (WCF) of the International Chamber of Commerce (ICC).
Today, this network unites guaranteeing associations from 65 countries of the world.
